TNCA needs to modify constitution to participate in BCCI AGM, says Vinod Rai

Committee of Administrators (CoA) head Vinod Rai has said that the TNCA has to modify its constitution if they wish to participate in the BCCI AGM. The TNCA’s amended constitution was reported to contain 21 diversions that made the board non-compliant with respect to the Supreme Court judgement.

With the BCCI AGM set to be held on October 22 and the final date for the nominations of candidates set to October 4, most state cricket boards are in the process of appointing representatives before the deadline. However, when it comes to the TNCA, proceedings have hit a halt as several amendments in its constitution make the board noncompliant with respect to the updated Lodha reforms.

“The TNCA has no option, but to modify its Constitution” in order to be in terms with the two apex court orders. “If 30 odd other members can do it, why not TNCA?” Rai further said as reported by Sportstar.

The CoA, after reviewing the amended constitution submitted by the TNCA on September 25, had found several infractions within the constitution.

“Various amendments have been made by the TNCA on a deliberate misinterpretation of the order of 20th Sept. 2018 and that it needs to accurately amend its Constitution," said Rai.

If the TNCA refuses to modify its constitution as a request by the CoA, then the board can take the matter to the court to decide on the matter.

“We can only take the horse to the water, but can’t make it drink. If the TNCA does not agree, it can go to the court,” added Rai.

Without maintaining compliance with the Supreme Court judgment, elected representatives of the TNCA would not be able to participate in the BCCI AGM that is set to be held next month.

"That will be decided by the Electoral Officer. The Former Chief Election Commissioner (CEC), Mr N. Gopalaswami, who is the BCCI Electoral Officer, has stated in the election schedule note that he will only entertain BCCI members who are determined to be BCCI Constitution compliant by the CoA," clarified Rai.

Earlier this month, following the September 20 ruling of the Supreme Court, the TNCA had conducted elections for different office posts. Rupa Gurunath was elected as the president and six others were elected for different office posts. The CoA, however, noted that the TNCA had elected two vice presidents during the election when the guidelines allowed only one person to hold that post. The TNCA would also need to come up with a solution to this discrepancy before time runs out.
