BCCI is monopolizing cricket in India, says Supreme Court

The Supreme Court on Monday accused the BCCI of running a “prohibitory regime” across the country, whereby the board is monopolizing the game. The bench also went on to add that it is not healthy for the sport that any player who wants to play in the country has to be contracted with the BCCI.

The bench comprising of Chief Justice T S Thakur and Justice Ibrahim Kalifulla questioned why every Indian cricketer needs to get the board’s nod. "You (BCCI) are running a prohibitory regime which is spread across the country. If a player has to play cricket he has to be with you. You have complete monopoly. You have monopoly over members and you prevent people from becoming members,” said the bench.

"Several youngsters in the country want to make their career in cricket and want to be Dhonis and Kohlis due to the glamour and glitz associated with it," the bench said. "They do not get equal opportunity if they are not on the right side of the BCCI. Sometimes they are prevented by the people at the helm of affairs."

The Supreme Court also appointed senior advocate Gopal Subramaniam as the amicus curiae, to seek his assistance in exploring all the recommendations of the Lodha committee, and how they could be implemented.

But Arvind Datar, who was appearing for the Tamil Nadu Cricket Association, opined against the Committee’s recommendation of one state-one vote, insisting it will create inequality rather than equality. "The recommendation will create inequality rather than equality. It will promote inquality among equals," he said.

But the bench shot back asking why the idea cannot work when every country, irrespective of size and population, gets only one vote at the ICC. "When ICC accepts the principle of one country-one vote irrespective of population, then why can't the similar formula of one state-one vote work for BCCI. It will result in equality to play cricket," the bench added.
