Mohammed Shami granted stay by High Court, doesn’t need to surrender
Mohammad Shami’s lawyer Salim Rahaman has stated that the notice issued for surrender to Mohammad Shami by a Kolkata court is no longer valid since he has managed to obtain a stay order by the High Court. Shami has been embroiled in a domestic violence case filed by his wife Hasin Jahan.
A little more than a week after news had emerged that Mohammad Shami has been issued an arrest warrant, he now no longer needs to report to Kolkata within the earlier stipulated period of 15 days to contest it. As per the recent development, the fast bowler’s lawyer has informed that it wasn’t an arrest warrant but a notice to surrender, against which the High Court has granted a stay order on his appeal.
“The order didn’t hold much ground because while you can summon a person, you cannot issue a surrender notice. We have got a stay on the matter from a higher court and the rest of the plan of action you will get to know tomorrow,” he was quoted saying by Hindustan Times.
The 29-year-old’s wife, Hasin Jahan had filed a case of domestic violence accusing him and his brother of committing illegal acts against her. The case has been going on for over a year now and after having issued a lengthy, passionate statement on August 29, the Alipore Court in Kolkata ordered Shami to surrender within 15 days.
A senior BCCI functionary had said that he would be returning to the country on September 12 after the Caribbean tour following which he will be spending some time in the US.
“Shami has gone to the US after the tour of the West Indies got over and he will be back in the country on the 12th. He has been in constant touch with his lawyer on the court matter and has also spoken to the relevant people within the board on the matter,” the functionary had said.
